The fourth hearing in the trial of pop star G\u00fcl\u015fen Bayraktar, who goes by the stage name G\u00fcl\u015fen, on charges of \u201cinciting the people to hatred and enmity\u201d was held at the \u0130stanbul 11th Criminal Court of First Instance on 3 May 2023.<\/p>\n

G\u00fcl\u015fen\u2019s lawyers attended\u00a0hearing<\/a>, which P24 monitored. Lawyers for plaintiffs submitted excuses not to attend the hearing.<\/p>\n

The prosecutor repeated their final opinion on the case at the third hearing of the trial on 1 March 2023 and requested that the singer be sentenced for \u201cinciting the people to hatred and enmity\u201d over her expression subject to the charge.<\/p>\n

Emek Emre, one of the lawyers representing G\u00fcl\u015fen, said that the content of the opinion of the prosecution was inconsistent with the case file. Criticizing the opinion for including social media reactions to his client\u2019s expression, lawyer Emre said, \u201cConstitutional Court deems social media reactions as intangible danger, whereas tangible danger needs to be established for elements of crime to exist.\u201d Emre added that several plaintiffs had not yet testified and that a case could not be completed without all complainants testifying. Emre and the other three lawyers representing G\u00fcl\u015fen requested their client\u2019s acquittal on grounds that elements of crime had not existed.<\/p>\n

The court sentenced G\u00fcl\u015fen to 10 months of imprisonment for \u201cpublicly denigrating a section of the people on grounds of differences of class, race, religion, sect, sex or region.\u201d The sentence was deferred.<\/p>\n

Background of the case<\/strong><\/p>\n

A video recording of G\u00fcl\u015fen joking with a band member during a concert in \u0130stanbul on 30 April 2022 was put in circulation on social media on 25 August 2022.<\/p>\n

Complaints against G\u00fcl\u015fen were filed with the Presidency of Communication (C\u0130MER) over her saying \u201c\u0130mam Hatip okumu\u015f, sap\u0131kl\u0131\u011f\u0131 oradan geliyor\u201d (\u201cHe went to a religious high school, that\u2019s why he is a pervert\u201d.)<\/p>\n

G\u00fcl\u015fen was detained on 25 August 2022, and put in pre-trial detention on the same day by the prosecutor\u2019s office on grounds that \u201cjudicial control measures would be insufficient.\u201d Placed in Bak\u0131rk\u00f6y Women\u2019s Closed Prison, G\u00fcl\u015fen was released after three days on house arrest.
