The second hearing of the <\/span>trial<\/u><\/span><\/a> of actor \u0130lyas Salman on the charge of \u201cinsulting the president\u201d (TPC 299) over his statement \u201cErdo\u011fan\u2019\u0131 o koltu\u011fa lay\u0131k g\u00f6rm\u00fcyorum\u201d (\u201cI don\u2019t think Erdo\u011fan is deserves that position\u201d) in an interview with the <\/span>BirG\u00fcn<\/i><\/span> newspaper that was published on 1 August 2022 was held at the \u0130stanbul 2<\/span>nd<\/span><\/sup> Penal Court of First Instance on 10 October 2023. <\/span><\/p>\n

Salman and attorneys for the parties were present at the <\/span>hearing<\/u><\/span><\/a>, which P24 followed. Delivering his defence statement following identification and the summary of the indictment, Salman said \u201cI have been doing comedy in this country for 50 years. I have never been as laughable as those who have brought us here to this courtroom\u201d and rejected the impugned crime.<\/span><\/p>\n

Salman\u2019s attorney U\u011fur Poyraz reminded the court of the European Court of Human Rights (ECtHR) judgment on Vedat \u015eorli and said that the legislation on the crime of \u201cinsulting the president\u201d was in violation of international conventions. Attorney Poyraz requested that the case be dismissed as per the Vedat \u015eorli judgment of the ECtHR: \u201cYou cannot establish a special status for the president and allow a privilege despite this decision. It is not lawfully possible to file this case. There can be no trial over a legal provision that does not exist.\u201d <\/span><\/p>\n

Speaking against the request of the attorney for President Erdo\u011fan to join the case as an intervening party, Salman said \u201cI think the complaint is invalid given the law and I do not accept their request to intervene\u201d. Attorney Poyraz said \u201cThe President does not have justification to intervene in this case. The judiciary should not be so scared. Courts should no longer encourage this behaviour.\u201d <\/span><\/p>\n

The court stated that despite the Vedat \u015eorli judgment of the ECtHR, the Constitutional Court had not found the legislation on the crime of \u201cinsulting the president\u201d to be unconstitutional and rejected the request for immediate acquittal on grounds of unconstitutionality. The court accepted President Erdo\u011fan\u2019s attorney\u2019s request to join as an intervening party. <\/span><\/p>\n

Attorney Poyraz stated that the court\u2019s interim order was unlawful and said \u201cI reject this court which has arrived at an unconstitutional decision\u201d. The court allowed Salman\u2019s attorney time to convey their request for recusation in writing. <\/span><\/p>\n
